Terms and Conditions

1. Validity
   These terms of trade govern the sale and supply of goods by 'AQUASOOTHE LIMITED' to you. 'AQUASOOTHE LIMITED' may amend these terms from time to time. You shall be notified of any amendments by a notice on the 'AQUASOOTHE LIMITED' site.
   
   
2. 'AQUASOOTHE LIMITED' Contract With You
   No contract shall exist between you and 'AQUASOOTHE LIMITED' until 'AQUASOOTHE LIMITED' has sent you an email confirming receipt and acceptance of your order. 'AQUASOOTHE LIMITED' is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods or the order appearing on 'AQUASOOTHE LIMITED' site or for unavailability (see 3. below). 'AQUASOOTHE LIMITED' reserves the right to place restrictions on the volume of any goods ordered.
   
   
3. Pricing and Availability
   The prices and availability of the goods are specified on the 'AQUASOOTHE LIMITED' site.
   
   
4. Payment
   ‘AQUASOOTHE LIMITED’ accepts payments by visa, access, mastercard, switch, maestro or postal cheques. We will process your order in compliance with both the Data Protection Act and Computer Misuse Acts.
   
   
5. Delivery of Goods
   ‘AQUASOOTHE LIMITED’ shall deliver the goods ordered to the delivery address which you supply within 7 days of placing the order. All delivery times quoted on the ‘AQUASOOTHE LIMITED’ site are estimates only based on availability, normal processing and delivery time. Title to the goods will pass to you on payment in full. Risk will pass to you on delivery.
   
   Where external couriers are used as part of the conditions of sale customers are required to inspect all goods on receipt and are able to annotate the courier’s documentation with detail of damage to either the packaging or the goods themselves. In all cases damage to the goods is to be reported to ‘AQUASOOTHE LIMITED’ within 24 hours of receipt of goods.
   
   
6. ‘AQUASOOTHE LIMITED’ Guarantee and Returns Policy
   If for any reason you are dissatisfied with any or all of the goods received, you can return any of them to ‘AQUASOOTHE LIMITED’ for an exchange or refund within 7 working days from the day after you receive the goods. You shall be responsible for the cost of returning goods for refund or exchange, except in cases of faulty, damaged or wrongly supplied goods. ‘AQUASOOTHE LIMITED’ recommends that you use registered post or recorded delivery when returning goods. 'AQUASOOTHE LIMITED’ shall use reasonable efforts to replace damaged or defective goods but if replacement is not possible or if an order is cancelled for any other reason under these Terms, ‘AQUASOOTHE LIMITED’ only obligation is to refund the full amount paid by you. This does not affect your statutory rights.
   
   
7. Your right to Cancel
   Under the Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item within seven working days of delivery. The cooling off period starts after the day of receipt of goods.
   
   ‘AQUASOOTHE LIMITED’ requires written confirmation on any cancellations.
   
   The product you wish to return must be in a saleable condition in its original, undamaged packaging, and we will consider the overall condition of the product being returned when making a refund. (This does not affect your statutory rights in the event of faulty goods.) Please note that you will be responsible for the cost of returning the goods to us unless we delivered the item to you in error or the item is faulty. If we do not receive the item back from you we may arrange for collection of the item from you at your cost.
   
   
8. V.A.T Exemption
   Most of our customers don't have to pay V.A.T so we display our prices excluding V.A.T, where the exemption allows.
   The government requires that you complete a V.A.T declaration form. To claim V.A.T relief on your purchases you just need to complete this simple online form which you will automatically be prompted to complete during the ordering process. Most of the form is already filled in for you; so you need to just check it, type your name and nature of your disability or illness.
   
   You will not have to pay V.A.T if you can declare that you are chronically sick or disabled. Chronically sick means that you have an illness that is likely to last a long time e.g. arthritis, angina. Disabled means substantially and permanent handicapped by illness or injury. you do not have to be registered disabled to claim relief from V.A.T, but the nature of your illness or disablement must be specified.
   
   
9. EU VAT
   AQUASOOTHE LIMITED’ is required to collect VAT at the relevant rate for orders being dispatched outside the UK. If VAT rates in the country of the destination of your order differ from those in the UK, the VAT will be recalculated and included in the product prices shown on the Order Summary page.
   
   
10. Governing Law and Jurisdiction
    Contracts between you and ‘AQUASOOTHE LIMITED’ shall be governed by English Law and all disputes shall be submitted to the non-exclusive jurisdiction of the English courts.
    
    
11. Invalidity of Terms and Conditions
    If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
